Terms of Service
Welcome to NYC Pizza Week. These Terms of Service ("Terms") govern your access to and use of the NYC Pizza Week website at nycpizzaweek.com, our text message (SMS) voting and updates, and any related services (collectively, the "Services"), operated by Still Hungry Hospitality LLC ("NYC Pizza Week," "we," "us," or "our").
Please read these Terms carefully. By using our Services, voting via text message, or signing up for our communications, you agree to these Terms. If you do not agree, please do not use the Services.
What NYC Pizza Week Is
NYC Pizza Week is a citywide celebration of independent pizzerias across New York City's five boroughs. During the event, participating shops offer a limited-edition "Pizza Week Special" slice, and customers can vote for their favorite by text message.
We are an event organizer and promoter, not a restaurant, seller, or food vendor. All pizza and other food is prepared, sold, and served by independent participating shops. Your purchase is a transaction between you and that shop. We are not a party to it.
Eligibility
You must be able to form a legally binding agreement to use the Services. The Services are intended for a general audience and are not directed to children under 13. By using the Services, you represent that the information you provide (such as your phone number or email) is accurate and belongs to you.
Voting
Voting for a Pizza Week Special is conducted by text message. By voting, you agree that:
- You should be a paying customer of a participating shop when you vote for its Pizza Week Special. Votes not associated with a genuine visit may be disqualified.
- You will vote honestly and will not attempt to manipulate, automate, or game the voting process (for example, using bots, bulk texting services, or scripts).
- We count votes at the phone-number level and take reasonable steps to prevent duplicate voting from the same number. Our system cannot prevent a person from voting using multiple different phone numbers, and we make no guarantee that all such attempts can be detected or prevented.
- We reserve the right to disqualify votes, voters, or results that we reasonably believe are fraudulent, automated, coordinated, or otherwise in violation of these Terms.
Voting results and winner selection are final and at our sole discretion. Winners are recognized for community and promotional purposes only and receive recognition (such as a trophy and press coverage) rather than a cash prize, unless we state otherwise in writing for a specific promotion.
Text Messages (SMS)
If you provide your phone number, you may receive text messages related to voting and event updates consistent with the consent you provide at signup. Message and data rates may apply, and message frequency may vary. You can opt out at any time by replying STOP, or reply HELP for assistance. Additional details are in our Privacy Policy.
Food, Allergens, and Your Health
We do not prepare, handle, or sell any food. All questions about ingredients, allergens, preparation, freshness, pricing, availability, and food safety are the responsibility of the individual participating shop.
If you have a food allergy, dietary restriction, or other health concern, you are responsible for confirming ingredients and preparation directly with the shop before ordering. NYC Pizza Week is not responsible for any allergic reaction, illness, injury, or other harm arising from food purchased from a participating shop.
Slice names, descriptions, and photos shown on our Services are provided by the shops and are for general promotional purposes. They may not reflect actual ingredients, portion sizes, pricing, or availability at any given time.
Participating Shops
Participating shops are independent businesses. We do not control them and are not responsible for:
- The quality, safety, price, or availability of their food;
- Their hours, service, or conduct;
- Whether a shop honors the Pizza Week Special or remains a participant for the full event;
- Any dispute between you and a shop.
Listing a shop on our Services is not an endorsement or guarantee of any kind.
Charitable Donation
A portion of proceeds from Pizza Week Special slices sold by participating shops is intended to support Slice Out Hunger, as described in our Services and in our agreements with participating shops. The donation is generated through participating shops, and we do not collect donations directly from customers as part of voting or using the Services.
Acceptable Use
When using the Services, you agree not to:
- Use the Services for any unlawful purpose;
- Interfere with or disrupt the Services, our systems, or our text messaging;
- Use bots, automated scripts, or bulk messaging tools to vote or interact with the Services;
- Attempt to gain unauthorized access to any part of the Services or our data;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Harass, threaten, or harm participating shops, our staff, or other users.
We may suspend or terminate your access to the Services at any time for conduct that violates these Terms.
Intellectual Property
The NYC Pizza Week name, logo, and branding (trademark pending), along with the content, design, and materials on our Services, are owned by Still Hungry Hospitality LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or use our name, logo, or content without our prior written permission, except as necessary to normally use the Services.
Third-Party Links and Services
Our Services may link to or rely on third-party websites and services (such as participating shops' pages, social media, or service providers). We are not responsible for the content, policies, or practices of any third party.
Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, or secure, that voting or messaging will always function, or that any information on the Services (including shop listings, slice details, or event dates) is accurate, complete, or current. Event dates, participating shops, and features may change or be canceled without notice.
Limitation of Liability
To the fullest extent permitted by law, Still Hungry Hospitality LLC and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the Services, your participation in NYC Pizza Week, or any food purchased from a participating shop.
Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Still Hungry Hospitality LLC and its owners, members, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, post a notice on our Services. Your continued use of the Services after changes take effect means you accept the updated Terms.
